Haryana Authorities Freeze Property Transactions in Gurgaon Colony Over Lapsed Development License

The Department of Town and Country Planning (DTCP) in Haryana has issued a decisive order to halt all execution of sale or conveyance deeds for properties located within Valley View Estate. This significant group housing colony spans 21.61 acres in the Gwalpahari area of Gurgaon. The regulatory action comes after the project's original development license, issued back in 1994, lapsed and remained unrenewed for over a decade, creating a major legal and administrative hurdle.

License Validity and Regulatory Failure

In a formal communication directed to the sub-registrar at Wazirabad and various district authorities, the office of the district town planner (enforcement) in Gurgaon clarified the timeline. The development license was originally granted on June 8, 1994, specifically for the development of a residential group housing colony in the revenue estate of village Gwalpahari. This license had a strict validity period, expiring on June 7, 2011.

The license was issued to the BSF Co-operative House Building Society Ltd., which was responsible for developing the colony, now popularly known as Valley View Estate. According to established rules, the licensee was required to apply for renewal at least one month before the expiration date. However, officials confirmed that the society failed to submit a renewal application within this stipulated timeline, despite receiving repeated communications and reminders from the DTCP department.

Impact on Residents and Prospective Buyers

This enforcement move is expected to have a substantial impact on current residents and prospective buyers within Valley View Estate. All property registrations and legal transactions will remain firmly on hold until the critical licensing issue is properly resolved. This resolution would require either the renewal of the original license or the acquisition of fresh approvals that are fully in line with current planning regulations and state laws.

Officials emphasized that the primary goal of this step is to prevent any further sale or transfer of residential units in a colony where the fundamental development license has not been renewed. This situation raises serious concerns regarding the colony's regulatory status and compliance with urban development norms.

Recent Hearing and Enforcement Actions

On December 8, 2025, representatives of the BSF Co-operative House Building Society appeared for an official hearing with the DTCP. During this proceeding, they conveyed their inability to secure the license renewal, even after paying the requisite charges and fees. Following this admission, the department made the conclusive decision to halt all property transactions within the colony indefinitely.

The DTCP has issued specific directives to the sub-registrar to ensure that a "red entry" is made in the official revenue records. This procedural mark is designed to actively prevent and block the registration of any property transactions related to Valley View Estate. The enforcement order has also been formally sent to the deputy commissioner and other relevant district officials to ensure strict and immediate compliance across all administrative levels.

Broader Regulatory Directives

District authorities have been explicitly instructed to guarantee that no registration of flats, plots, or any other residential units within Valley View Estate takes place until further official orders are issued. This comprehensive freeze aims to maintain regulatory integrity and protect potential buyers from investing in properties with unclear legal standing due to the lapsed development license.

The situation underscores the importance of adherence to urban planning regulations and highlights the consequences when development licenses are not maintained or renewed in a timely manner, affecting entire residential communities.
