Telangana RERA Issues Stern Warning Against Illegal Pre-Launch Advertisements

The Telangana Real Estate Regulatory Authority (TG-RERA) has issued a firm and unequivocal warning to all promoters, developers, real estate agents, and advertising channels operating within the state. The authority has explicitly prohibited the practice of misleading prospective homebuyers through pre-launch advertisements that are published without obtaining a valid TG-RERA registration.

Strict Adherence to the RERA Act Mandated

The authority has strongly emphasised that any attempt to attract potential buyers or solicit investments for a real estate project before securing formal registration constitutes a direct and serious violation of the Real Estate (Regulation and Development) Act, 2016. Under the stringent provisions of this central legislation, registration with TG-RERA is mandatory for every real estate project that exceeds a land area of 500 square meters or proposes the construction of more than eight apartments.

Developers are only permitted to commence advertising, marketing, or selling any units after the Authority has conducted a thorough and complete scrutiny of all project details and has officially assigned a unique RERA registration number to the project. This critical registration number must then be displayed prominently and clearly in all promotional materials, advertisements, and marketing collaterals without exception.

Show-Cause Notices Issued to Major Projects

In strict enforcement of these regulations, TG-RERA has proactively issued formal show-cause notices to several project entities after discovering illegal advertisements that conspicuously failed to display the mandatory registration number. The list of entities currently under the authority's scrutiny includes several prominent names in the Hyderabad real estate market.

In a particularly notable case involving Swargaseema Construction's Ameya project, the authority documented multiple and serious violations. These included the use of non-compliant font sizes for mandatory disclosures and the critical omission of the project's full and official name from advertisements.

Furthermore, and perhaps most misleadingly, the project was officially registered with RERA merely as a 'layout' plan. However, it was being advertised to the public as a 'full residential project,' a discrepancy that could significantly mislead potential investors about the nature and scope of the development.

This crackdown underscores TG-RERA's commitment to enforcing transparency and protecting homebuyers from misleading marketing practices that have historically plagued the real estate sector. The authority's actions serve as a clear reminder to all stakeholders about the legal and ethical requirements for advertising real estate projects in Telangana.
