New Delhi: A Delhi court on Tuesday granted interim bail to Yash Yadav, an accused in the NEET-UG 2026 paper leak case, enabling him to appear for the re-examination scheduled on June 21 and attend his sister's wedding.

Court's Observations

Special Judge Vishal Gogne of Rouse Avenue Courts observed that Yadav's "rights as a student could not be defeated by denial of the opportunity to appear in the examination." The court emphasized the importance of educational opportunities for the accused.

Arguments Presented

Yadav's counsel argued that his status as an accused should not "act to his detriment" in pursuing the retest, particularly in light of the fundamental right to education. The counsel stressed that denying him the chance to appear would be unjust.

The Central Bureau of Investigation (CBI), however, contended that Yadav was among the conspirators involved in the sale of the question paper. The agency also expressed apprehensions that he could go on the run if granted bail.

Court's Directions

The court directed the Superintendent of Central Jail, Tihar, to facilitate the download of Yadav's admit card by June 17. It ordered that he be produced in judicial custody at 12 noon at his examination centre in Gurgaon and be returned to custody immediately after the retest. This ensures strict supervision while allowing him to exercise his educational rights.

The interim bail is specifically for the examination period and wedding attendance, reflecting the court's balance between legal proceedings and personal liberties.
