Orissa High Court Grants Final Opportunity to PhD Scholar, Overturns University Deregistration
The Orissa High Court has intervened to provide a crucial lifeline to a PhD scholar from Fakir Mohan University, setting aside her deregistration and granting her a final chance to complete her doctoral studies. This significant ruling was delivered by a single-judge bench of Justice Ananda Chandra Behera on Friday, following a petition filed by the student challenging the university's decision.
University's Deregistration Order and Legal Challenge
On May 28, 2025, the Controller of Examinations at Fakir Mohan University issued an order cancelling the scholar's PhD registration. The university cited repeated failures to complete the programme and non-payment of fees as the primary reasons for this action. During the court hearing, the counsel representing the university and the state government strongly opposed the student's plea. They argued that her conduct and attitude did not justify renewing her registration, labelling her as a continuous defaulter who had failed multiple attempts to finish her PhD. Notably, the counsel contended that the deregistration was initiated at the instance of her own guide, adding weight to the university's stance.
Court's Compassionate Ruling and Observations
Despite the opposition, Justice Behera ruled in favour of the student, emphasising the importance of providing her with a final opportunity. The judge observed that the petitioner was eagerly interested to complete her PhD and that denying relief would be unjust, especially as she sought to achieve what she described as the last goal of her life. Justice Behera noted that restoring her registration would not adversely affect any party and would serve the best interests of both the petitioner and society at large. He concluded that there was no justification to disallow this Writ Petition, highlighting the court's commitment to fairness and educational advancement.
Specific Directions Issued by the High Court
In his order, Justice Behera quashed the university's deregistration directive and issued clear instructions for compliance. The court directed the university authorities to renew the petitioner's PhD registration number in accordance with University Grants Commission (UGC) norms. This renewal must be completed within 15 days from the date of submission of the certified copy of the judgment. Additionally, the university is required to permit the scholar to continue her research under a guide, as per applicable regulations. The court's disposal of the petition underscores its role in safeguarding academic opportunities and ensuring procedural adherence in higher education.
