In a statement to People, they wrote, "Defendants will be serving an amended witness list reflecting that dismissed defendants Justin Baldoni, producer Jamey Heath and crisis publicist Melissa Nathan will appear to provide in-person testimony as their testimony remains relevant to refute Plaintiff’s false allegations of a smear campaign."

The report further notes that other previously named defendants, such as Steve Sarowitz and Jennifer Abel, will not testify in person but will provide their statements via deposition. Baldoni's legal team also resisted Lively's request for immediate clarification on which witnesses would testify live versus through deposition, adding complexity to the pretrial preparations.
