Bodh Gaya Foreign Monasteries Under Scrutiny for Alleged Commercial Malpractices

An official inquiry has been launched into allegations of wrongdoing by foreign monasteries operating in the sacred pilgrimage town of Bodh Gaya, Bihar. The investigation was initiated by District Magistrate Shashank Shubhankar following formal complaints from local stakeholders, including the Bodh Gaya Hotel Association, who have raised serious concerns about alleged malpractices.

Formation of Inquiry Committee and Timeline

The probe is being conducted by a four-member committee headed by Additional District Magistrate (Law and Order) Md Shafiq. The committee includes the Gaya Sadar Sub-Divisional Magistrate, the Chief Executive Officer of the Bodh Gaya Nagar Parishad, and the Circle Officer of Bodh Gaya. This team has been directed to complete their investigation and submit a comprehensive report by March 7, 2024. Subsequent actions will be determined based on the committee's findings.

Scope of Allegations Against Foreign Monasteries

According to the complaints, there are more than fifty functional foreign monasteries in Bodh Gaya that were originally established for religious purposes. However, these institutions are now allegedly engaged in various commercial activities that violate their intended purpose. The specific allegations include:

  • Sale of personal-use items to tourists and pilgrims
  • Commercial distribution of articles used in religious rituals
  • Marketing of souvenirs and mementos to visitors
  • Commercial operation of monastery guest houses for profit

Complainants assert that these activities are causing significant financial losses to both the public exchequer and local businesses. The monasteries are accused of failing to comply with regulations concerning foreign exchange, commercial taxes, service charges, and other financial obligations that legitimate commercial entities must follow.

Regulatory Violations and Past Notices

The allegations extend beyond commercial activities to include serious regulatory violations. While organized hospitality businesses are required to submit Form C to the foreign section of district police upon arrival of foreign nationals, the foreign monasteries allegedly do not comply with this regulation. Furthermore, provisions of the Foreigners Act are reportedly not being properly adhered to by these institutions.

This is not the first time these monasteries have faced official scrutiny. On multiple occasions in the past, municipal authorities have served notices to various monasteries regarding:

  1. Encroachment on public land
  2. Alleged clandestine transactions involving unsaleable land
  3. Violations of building construction norms and regulations

As a precautionary measure pending completion of the inquiry, the monasteries have been restrained from undertaking any new construction or renovation of existing structures.

Responses from Stakeholders

Tensing, President of the Bodh Gaya-based International Buddhist Council, stated that he was not aware of any inquiry ordered by the District Magistrate. "The monasteries have their own distinct character," said Tensing, suggesting that the unique nature of these religious institutions might require different considerations.

Md Shafiq, the ADM heading the inquiry committee, confirmed that the investigation is in its initial stages. "A detailed survey of all monasteries is being conducted," he stated, adding, "I have little to say at this stage as the process is just beginning." This indicates that the committee is currently gathering information and evidence before reaching any conclusions.
