A tragic incident occurred in Noida Extension on Saturday, where a 46-year-old biker lost his life after a concrete chunk fell from an overhead beam inside a housing society. The victim, identified as Vikas Chawla, was leaving the Arihant Amber society on his motorcycle when the accident happened around 4 pm.
Details of the Incident
According to Tushar, the president of the Apartment Owners Association (AOA), Chawla had just taken his bike out of the parking area of Tower D and entered the open space when a portion of the roof beam fell on him. The impact caused him to lose balance and crash into the corner of a tower wall, striking his head. Residents nearby raised an alarm and rushed him to Yatharth Hospital, but doctors declared him dead on arrival.
Chawla lived in Tower D (flat 1507) with his wife, two children, and parents. He worked for a private company in the city. His younger brother, Deepak, filed a complaint, stating that the family had been living in the society on rent for the past five years. Deepak alleged that the concrete chunk fell as Chawla’s bike turned past the tower corner, and he sustained severe injuries.
Negligence Allegations
Deepak held the builder and the society’s AOA responsible for poor upkeep, demanding strict action for their negligence. However, the AOA president blamed the builder for poor construction quality, claiming they had repeatedly complained about the issue. In 2023 and 2024, written complaints were given, and the builder’s office was visited, but no action was taken. The AOA also approached the Real Estate Regulatory Authority (Rera) in 2024, leading to repair work that stalled within months.
Residents have been struggling for years to get the plaster problem fixed. About a month ago, the AOA wrote to the Sub-Divisional Magistrate (SDM), warning about the condition of the buildings. Ashutosh Srivastava, another resident, said they had raised the issue with the Greater Noida Authority multiple times without any response.
Legal Action
Jitendra Kumar Singh, ACP-2 (central Noida), confirmed that an FIR was registered at Bisrakh police station against the builder and the AOA under BNS Section 106 (causing death by negligence). The maintenance in-charge has been arrested, and the police are examining the AOA’s role. The builder will be contacted soon.
The society comprises 628 flats across four towers, with 625 families currently residing there. Possession was granted in 2019, and the first AOA was formed in 2023, after which the builder handed over the society.
