Delhi Court Orders 14-Day Judicial Custody for Couple in Racist Remarks Case
A city court in New Delhi on Wednesday remanded Harsh Priya Singh and his wife Ruby Jain, residents of Malviya Nagar, to 14 days of judicial custody. This decision came after a video allegedly showing the couple making racial remarks against three women from Arunachal Pradesh went viral on social media platforms, triggering widespread public outrage and condemnation.

Sessions Judge Samar Vishal, while granting the judicial custody application, stated, "Considering the facts and circumstances of the case, and the reasons given for seeking judicial custody, the application is allowed." The court has remanded the accused to judicial custody until March 10, 2025.
The court noted that the couple has been charged under multiple sections of the newly implemented Bharatiya Nyaya Sanhita (BNS). Specifically, Section 196 — which deals with promoting enmity between different groups on grounds of race — has been invoked, constituting a non-bailable offence. Additionally, provisions of Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 have been applied against Ruby Jain, which are also non-bailable in nature.

The defense counsel strongly opposed the charges, arguing that the incident originated from a "simple neighbourhood argument" that escalated only after the video was circulated online. The defense contended that Section 3 of the SC and ST Act cannot be applied in this case because the alleged incident occurred within a residential complex, whereas the relevant provision specifically applies to insults and intimidations committed in "public view."
Furthermore, the defense disputed the characterization of the remarks as racist. "Instead, it is an example of stereotyping," the counsel submitted, adding that no specific derogatory terms targeting a particular community were used in the video.
