North Goa Consumer Commission Slaps Construction Firm with Rs 2.25 Lakh Penalty for Service Failure
In a significant ruling that underscores consumer rights, the North Goa consumer disputes redressal commission has taken strict action against a construction company for severe deficiency in service. The commission has ordered Classic Modular Kitchen to pay a substantial compensation of Rs 2 lakh, along with 8% interest, to Sairaj Talkatkar, a resident of Assagao. Additionally, the firm must pay Rs 25,000 specifically for the mental torture and litigation costs incurred by the complainant.
Details of the Failed Renovation Agreement
The case originated in July 2024 when Sairaj Talkatkar engaged the services of Classic Modular Kitchen for a comprehensive kitchen renovation project at his Assagao residence. Based on an oral agreement between both parties, Talkatkar made a payment of Rs 2 lakh to the construction company on August 11, 2024. The company had explicitly agreed to complete all renovation work within three weeks of receiving this payment.
However, the promised timeline was completely disregarded. Despite multiple attempts by Talkatkar to contact the company and follow up on the progress, the firm repeatedly made excuses, primarily citing non-receipt of necessary stock as the reason for the delay. This failure to provide the agreed-upon services led to significant disruption in Talkatkar's daily life.
Consequences of the Prolonged Delay
The prolonged delay in the kitchen renovation created considerable hardship for the Talkatkar household. With the renovation work stalled indefinitely, the house descended into a state of disarray, making it extremely difficult for the family to locate their essential belongings. The mess and inconvenience persisted for an extended period, directly impacting their quality of life.
In an effort to resolve the matter, Talkatkar escalated the issue by sending a formal legal notice to Classic Modular Kitchen. Shockingly, the construction company did not respond to the complaint and even returned the notice endorsed as 'Unclaimed', demonstrating a clear disregard for legal protocols and consumer grievances.
Commission's Observations and Ruling
The consumer commission, presided over by President Bela Naik and Member Auroliano de Oliveira, thoroughly examined the case. The bench observed that despite Classic Modular Kitchen having a close friendship with Talkatkar's brother, the company utterly failed to deliver the services as promised. Moreover, the firm provided multiple false assurances to Talkatkar that the work would be completed promptly, actions which the commission found amounted to cheating the consumer.
In its final order, the commission held the construction company fully liable for the deficiency in service and the resultant hardships. The directive includes:
- Payment of the principal amount of Rs 2 lakh to Sairaj Talkatkar.
- Interest at the rate of 8% per annum on the Rs 2 lakh from the date of payment until actual realization.
- An additional compensation of Rs 25,000 specifically for the mental torture endured and to cover litigation costs.
This ruling serves as a strong reminder to service providers about their contractual obligations and the legal consequences of failing to meet consumer expectations.
