Jharkhand HC Directs Better Medical Care for Banned Outfit Leader Dinesh Gope at AIIMS Delhi
Jharkhand HC Orders Better Medical Treatment for Dinesh Gope at AIIMS

The Jharkhand High Court has issued a significant directive concerning the medical treatment of a former banned outfit leader, emphasizing the importance of adequate healthcare for prisoners regardless of their legal status.

Court Intervention for Medical Care

On Tuesday, the Jharkhand High Court took decisive action by directing the superintendent of Medininagar jail to ensure better medical treatment for Dinesh Gope, the former supremo of the banned People's Liberation Front of India (PLFI). The court specifically ordered that Gope receive appropriate care at the prestigious All India Institute of Medical Sciences (AIIMS) in Delhi.

Petition for Improved Healthcare

Justice Gautam Kumar Choudhary was presiding over a petition filed by Gope himself, who sought improved medical attention for his deteriorating health condition. The former PLFI leader is reportedly suffering from a serious neurological disorder that requires advanced and specialized medical intervention beyond what local facilities can provide.

Medical Committee Recommendations

A specialized medical committee from the Rajendra Institute of Medical Sciences (RIMS) had thoroughly examined Gope and reached a clear conclusion. The committee strongly recommended that his treatment should continue at a specialized medical centre with advanced facilities. They explicitly stated that his neurological condition could not be adequately treated at the Ranchi health facility and advised immediate referral to AIIMS for comprehensive care.

Background of the Case

Dinesh Gope's legal journey has been complex and marked by health challenges. He was arrested by the Jharkhand Police in collaboration with a National Investigation Agency (NIA) team after being apprehended in Nepal on May 21, 2023. Initially, he was lodged at Birsa Munda Central Jail in Hotwar, Ranchi, where he sustained a hand injury last year. Subsequently, in September 2024, he was transferred to Medininagar jail.

Progressive Health Deterioration

Although Gope initially received treatment at RIMS, his neurological complications continued to worsen over time. This progressive deterioration necessitated his referral to AIIMS for specialized care that could address his complex medical needs. In May 2024, the High Court was informed that authorities were actively making efforts to secure an appointment with a specialist at AIIMS, indicating the seriousness of his condition.

Court Directives and Future Proceedings

The High Court has taken a comprehensive approach to this matter. Beyond directing improved medical treatment, the court has also instructed the state government to file a detailed response and submit a status report on the progress of Gope's medical care within a fortnight. This demonstrates the court's commitment to ensuring proper follow-up and accountability in this sensitive case.

The matter has been scheduled for further hearing on February 17, when the court will review the implementation of its directives and assess the progress made in Gope's medical treatment. This ongoing judicial oversight underscores the importance the court places on the fundamental right to healthcare, even for individuals facing serious legal charges.

The case highlights the intersection of legal proceedings and medical necessity, raising important questions about prisoner healthcare rights and the responsibilities of correctional facilities to provide adequate medical attention to inmates with serious health conditions.
