  • Section 302 for the premeditated murder of the victim
  • Section 201 for deliberately causing the disappearance of crucial evidence
  • All read in conjunction with Section 34, which addresses acts committed by multiple persons with a shared intention

The victim was identified as Amit Kumar, a young boy whose life was tragically cut short.

Sequence of Events Leading to the Arrest

Complainant Amrinder Kumar provided a harrowing account to the authorities. On the morning of June 16, 2022, his wife alerted him that their son Amit had gone to play at Mukesh Kumar's residence but had not returned. A search of the quarter revealed both the accused and the child were missing.

Later that evening, around 9 PM, Mukesh contacted Amrinder, informing him that Amit was in his custody. He demanded a ransom of Rs 1,50,000 and issued threats of severe consequences if the payment was not made. Initially, an FIR was lodged solely against Mukesh under Section 364-A.

During the subsequent investigation, Amrinder submitted a supplementary statement. He indicated that Vikas frequently visited Mukesh's quarter and that Mukesh had taken Amit to Vikas on a motorcycle. The complainant expressed absolute certainty that both accused were responsible for murdering his son.

Key Testimonies and Evidence Presented in Court

Mithun, also known as Mithu, a co-worker of Vikas, played a pivotal role in the investigation. He informed the police that Vikas had confessed to kidnapping the boy alongside Mukesh with the aim of obtaining ransom. However, overwhelmed by fear, they proceeded to strangle the child and dispose of his body in a river.

Law enforcement agencies acted swiftly, arresting both accused individuals. On June 18, 2022, based on disclosures from Vikas, the police recovered Amit's slippers. The following day, his body was discovered near Kaind Bridge Canal and was formally identified by the grieving complainant.

During the trial, prosecution witness Suba Lal provided crucial testimony. He stated that on June 15, 2022, he observed Vikas and Mukesh near Neelo Canal with a child aged approximately 10 to 12 years. The child's hands were tied, and Suba Lal witnessed the accused strangling him. Another witness, Shiv Pujan, corroborated parts of the timeline, testifying that he had seen the accused with a child on a motorcycle earlier that same day.

Court's Final Ruling and Dismissal of Defence Claims

The defence team argued that their clients were falsely implicated in the case. However, the court found the testimonies of the witnesses to be natural, consistent, and highly reliable. Judge Amandeep Kaur upheld the prosecution's narrative, leading to the conviction and the subsequent sentencing to life imprisonment.

This verdict underscores the judiciary's firm stance against crimes targeting minors and serves as a stern warning to those contemplating similar heinous acts. The community hopes this judgment brings a measure of closure to the victim's family after their prolonged ordeal.
