Supreme Court Takes Strong Stand Against Misuse of Rape Laws

The Supreme Court of India delivered a significant judgment on Monday, strongly condemning the practice of giving consensual physical relationships the color of rape. The court emphasized that such actions trivialize the seriousness of sexual offenses and cause grave injustice to the accused.

Case Background: Lawyer-Client Relationship Turns Sour

According to prosecution details, the case originated when a woman approached a lawyer seeking maintenance from her estranged husband. During their professional engagement, the two individuals developed a personal relationship that turned intimate. The woman became pregnant in September 2022 and underwent an abortion with the lawyer's consent.

The relationship continued, resulting in two additional pregnancy terminations. When the lawyer refused marriage proposals and allegedly threatened the woman if she made their relationship public, she filed a rape case against him.

Court's Strong Observations and Judgment

A bench comprising Justice B V Nagarathna and Justice R Mahadevan quashed the rape case while making crucial observations about the misuse of criminal laws. The court noted that the accused lawyer claimed their relationship was entirely consensual and that the rape allegation surfaced only after he refused to pay Rs 1.5 lakh demanded by the woman.

The judgment stated: "This Court has, on numerous occasions, taken note of the disquieting tendency wherein failed or broken relationships are given the colour of criminality. The offence of rape, being of the gravest kind, must be invoked only in cases where there exists genuine sexual violence, coercion, or absence of free consent."

The bench further elaborated that converting every sour relationship into a rape offense not only diminishes the seriousness of genuine rape cases but also inflicts indelible stigma and grave injustice upon the accused.
