In a dramatic turn of events, Shivam Mishra, the son of a prominent Kanpur tobacco baron, was arrested on Thursday morning in connection with the high-profile Lamborghini crash that occurred on Sunday. However, he was released on a personal bail bond of Rs 20,000 just a few hours later, following a court hearing that highlighted significant procedural lapses by the police.
Court Criticizes Police for Procedural Lapses in Arrest
The court of Additional Chief Judicial Magistrate (VII), Kanpur Nagar, Amit Singh, played a pivotal role in the case. During the proceedings, the magistrate noted that the police had failed to obtain prior approval for Shivam's arrest, as mandated under section 35(6) of the Criminal Procedure Code (CrPC). This oversight led to the court denying the police's request for a 14-day judicial custody for Shivam.
When questioned by the ACJM about whether the arrest followed the required formalities under section 35(6), the prosecution admitted that it did not. They justified the arrest by stating it was based on a tip-off suggesting that the accused might flee. However, the court firmly held that this constituted a breach of legal requirements, emphasizing the importance of adhering to procedural norms in such cases.
Arrest and Bail Proceedings Amidst Court Disruptions
Shivam Mishra was produced before the court after his arrest near his home on Thursday morning. His lawyer promptly filed a bail application, but the proceedings were complicated by a boycott of judicial work by a large section of lawyers. This boycott was in response to a call by two advocate associations, which disrupted court activities.
As a result, the defence withdrew the bail application. The ACJM clarified that he was only addressing the remand application at that time. Ultimately, the court rejected the police's application for custody and released Shivam on furnishing a bond of Rs 20,000. The release came with strict conditions: Shivam must cooperate fully with the ongoing investigation and must not attempt to influence any witnesses.
