In a significant move to cleanse the legal profession, the Bar Council of Uttar Pradesh has taken a firm stand against advocates with serious criminal backgrounds. The council informed the Allahabad High Court that it has decided to suspend the licenses of lawyers who are officially listed as history-sheeters or gangsters in police records.
Unanimous Decision and Disciplinary Actions
The Bar Council's submission revealed that the decision was taken unanimously. This step underscores a proactive effort to uphold the integrity of the legal system. Furthermore, the council informed the court that it had taken suo motu cognisance against 98 advocates based on their criminal records. Out of these, disciplinary proceedings against 23 lawyers are currently pending before the council's disciplinary committee.
Court Hearing and Further Directives
The matter came to light during a hearing before a bench of Justice Vinod Diwakar. The hearing was for a petition filed by advocate Mohammad Kafeel, who himself is facing a series of criminal cases. The charges against Kafeel include those under the stringent UP Gangsters Act, as well as forgery, extortion, and criminal conspiracy.
The court granted the Bar Council additional time to submit a pendrive containing the details of all advocates who have been issued certificates of practice. This data is intended for cross-referencing with the police records. The bench also took on record a compliance affidavit filed by the state government, which was accompanied by a district-wise list of cases registered against lawyers across Uttar Pradesh.
