Lok Sabha Approves IBC Amendment Bill to Strengthen Insolvency Framework

Finance Minister Nirmala Sitharaman declared on Monday that the Lok Sabha's passage of the Insolvency & Bankruptcy Code (IBC) amendment bill is set to maximize value for all stakeholders involved. She emphasized that this legislative move aims to fortify the existing insolvency framework while tackling practical challenges head-on.

Enhancing Banking Sector Health and Global Standards

Sitharaman highlighted that the IBC has been a pivotal factor in improving the overall health of India's banking sector. The 12th Amendment, she noted, incorporates evolving global best practices to ensure the system remains robust and competitive on an international scale. This update is designed to address delays often caused by extensive litigation from promoters, with the bill specifically targeting speedier resolutions and reducing frivolous proceedings.

New Mechanisms for Efficient Resolution

A key feature introduced in the amendment is the Creditor-Initiated Insolvency Resolution Process. This new out-of-court mechanism operates on a compressed timeline of 150 days, aiming to expedite insolvency cases significantly. Sitharaman assured that the amendments prioritize the protection of workmen dues, ensuring they are not overlooked in the resolution process.

Boosting Investor Confidence with Advanced Frameworks

Additionally, the bill includes an enabling framework for group insolvency and cross-border insolvency. These provisions are intended to promote greater investor confidence by providing clearer guidelines and smoother processes for complex insolvency scenarios involving multiple entities or international aspects. Sitharaman reiterated that these changes are crucial for maintaining a transparent and efficient economic environment in India.
