The Allahabad High Court, including its Lucknow Bench, has proposed extending the tenure of Law Clerks (Trainee) and Research Associates from the current two years to a maximum of three years. This initiative is designed to enhance judicial efficiency by providing sustained support to judges in legal research and case analysis.
Reason for the Proposal
Officials stated that the proposal is driven by the increasing pendency of cases in the court. Law Clerks and Research Associates play a crucial role in assisting judges by identifying relevant legal provisions, precedents, and factual aspects of cases. Their work helps save valuable judicial time, allowing judges to focus on adjudication.
Current Strength and Remuneration
At present, 135 Law Clerks (Trainee) and Research Associates are engaged to support the judges. Each of them receives a monthly honorarium of ₹40,000. The proposed extension aims to retain experienced personnel for a longer period, thereby improving the quality of research support.
Alignment with Supreme Court Order
The proposed extension is in line with the order dated May 20, 2025, passed by the Supreme Court of India. This ensures that the High Court's move is consistent with the highest judicial authority's guidelines on the matter.
Impact on Judicial Functioning
Extending the tenure is expected to reduce the time spent on training new clerks and associates, as experienced staff will continue to contribute. This continuity is likely to improve the efficiency of case management and legal research, ultimately aiding in faster disposal of cases.
