Bombay HC Orders Inspection of Land Filling in Merces

Panaji: The Bombay High Court on Monday directed its appointed task force to inspect a site in Morombi o Pequeno, Merces, where large-scale land filling has been reported. The court ordered the task force to submit a detailed report on the extent of filling and the damage caused to nearby mangroves and khazans (traditional agricultural fields).

Court Takes Note of Evidence

The petitioner submitted photographs showing extensive filling, which the court formally took on record. The bench also instructed the task force to assess the environmental cost required to restore the land to its original condition and to recover that amount from those responsible for the violation.

The court warned that violators would face contempt of court proceedings and legal action under the Environment Protection Act and other applicable laws.

Waste Management Directive

Further, the High Court directed the Goa Waste Management Corporation to identify at least two to three landfill sites within Tiswadi for dumping the excavated soil. While a site at Tuem in Pernem had been designated earlier, the court noted that it appeared uneconomical due to the distance from the affected area. The court questioned why no suitable sites were available within Tiswadi itself.

The case highlights ongoing concerns about environmental degradation in coastal regions and the judiciary's role in enforcing environmental safeguards. The task force report is expected to guide further legal action and restoration efforts.
