Noida Excise Department Issues Strict Warning Against BYOB Practices and Pricing Violations
The excise department in Noida has taken a firm stance against bars and restaurants promoting or allowing "bring your own booze" (BYOB) arrangements, declaring that such practices are not recognized under the district's regulations. This directive comes as officials have observed a noticeable increase in establishments using BYOB signage as a marketing strategy to attract customers.
Clarification on BYOB and Licensing Categories
District Excise Officer Subodh Kumar issued these instructions during a meeting with holders of Foreign Liquor-11 (occasional bar) licences. He emphasized that BYOB, which typically refers to situations where hosts or restaurants do not serve alcohol and guests bring their own drinks, has no legal provision in Gautam Budh Nagar. Any establishment found advertising or permitting BYOB will face action for violating excise norms.
Kumar clarified that under the revised UP Excise Policy 2025-26, the occasional bar licence has been divided into two distinct categories: one for commercial operations by bars and restaurants, and another for community events like weddings and private parties. While commercial operations are permitted under this licence, BYOB is explicitly excluded.
Strict Enforcement of Liquor Pricing Norms
In addition to the BYOB crackdown, the excise department has highlighted serious violations related to liquor pricing. Officials have noted that some bars and restaurants are selling alcohol at or near the maximum retail price (MRP), which contravenes established excise regulations. According to Kumar, all licensed bars are required to sell liquor at 20% above the approved MRP.
He stated, "Selling liquor at MRP, close to it, or at discounted rates is illegal. Pricing norms have to be strictly followed." To ensure compliance, the department plans to intensify enforcement checks and take stringent action against offenders under the Uttar Pradesh Excise Act, 1910, and related rules.
Additional Licensing and Safety Requirements
The excise department also addressed other regulatory aspects for FL-11 licence holders. While a Fire No Objection Certificate (NOC) is not mandatory for obtaining an FL-11 licence, Kumar advised establishments that operate regularly under this licence to secure one as a safety precaution. Bars functioning frequently under FL-11 should proactively apply for a Fire NOC.
Furthermore, outlets running bars from malls or permanent commercial complexes have been directed to transition to regular licensing. These FL-11 holders must apply for a permanent FL-7 licence at the earliest to avoid potential legal issues. Kumar reiterated that all FL-11 licensees must adhere strictly to standard operating procedures and the Excise Policy 2025-26 to maintain compliance.
