In a significant ruling, the First Additional Special Judge for CBI cases in Visakhapatnam, P. Vijaya Durga, delivered convictions on Friday against five officials from the State Bank of India (SBI) and two private individuals. This decision marks a crucial step in addressing a substantial bank fraud case that has drawn considerable attention.

Details of the Convicted Individuals

The convicted parties include several former SBI employees and private associates involved in the fraudulent activities. Specifically, the individuals are:

  • Kalluri Satyanarayana (A1): Former relationship manager for medium enterprises at SBI's Sales Hub in Kakinada, East Godavari district.
  • Chaganti Chalapathi (A2): Former branch manager at SBI.
  • Nidadavolu Venkata Ramana Rao (A3): Former branch manager at SBI.
  • Manapragada Ramana (A4): Former assistant manager for advances at SBI's Anaparthy Branch in East Godavari district.
  • Mallidi Venkata Narayana Reddy (A5): Managing director of VNR Refineries Private Ltd, based in Vemulapalli - Dwarapudi, Mandapeta Mandal, East Godavari district.
  • M Venkata Narayana Reddy (A6): A private individual associated with the case.
  • P Subba Rao (A7): Former assistant manager for agriculture advances at SBI's Anaparthy Branch.

Sentencing and Financial Penalties

Following the conviction, the court imposed strict sentences and fines. Individuals A1 through A4 received three years of simple imprisonment each. A5 was sentenced to two years of simple imprisonment. Additionally, all convicted parties from A1 to A7 were collectively fined Rs 1,15,000, underscoring the severity of their actions.

Nature of the Fraudulent Scheme

According to CBI officials, the fraudulent activities occurred between 2008 and 2011. During this period, the convicted individuals conspired to cheat SBI's Anaparthy Branch by fraudulently securing credit facilities for VNR Refineries, represented by A6. The scheme involved A5 colluding with bank officials (A1 to A4 and A7) to obtain loans through deceptive means.

Key tactics included concealing prior mortgages and submitting tampered documents as security for the loans. The SBI officials abused their positions by violating established banking rules, ignoring due procedures, and falsely certifying documents to facilitate the unauthorized loans. This misconduct resulted in a wrongful loss to the bank and wrongful gain to the perpetrators, with an outstanding amount totaling Rs 9.19 crore.

Legal Charges and Trial Outcome

After a thorough trial, the court convicted A1 to A4 and A7 under multiple legal provisions. These include Sections 120-B (criminal conspiracy) and 420 (cheating) of the Indian Penal Code (IPC), as well as Section 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988. For A5 and A6, the convictions were under Sections 120-B, 420, 468 (forgery for purpose of cheating), and 471 (using as genuine a forged document) of the IPC.

This case highlights ongoing efforts to combat financial crimes and corruption within the banking sector, serving as a reminder of the legal consequences for such fraudulent activities.
