The complainant had booked a flat in a project launched by the builder in Ludhiana and paid a total of ₹11.72 lakh. However, the builder failed to deliver possession within the stipulated time and also did not execute a sale agreement. The complainant approached the consumer commission seeking a refund with interest.
Commission's Verdict
After hearing both parties, the commission observed that the builder had indulged in unfair trade practices by not fulfilling the promise of timely possession. The commission directed the builder to refund the entire amount of ₹11.72 lakh along with 9% interest from the date of each payment until the actual refund. Additionally, the builder was ordered to pay ₹25,000 as compensation for mental agony and ₹5,000 towards litigation costs.
The commission also noted that the builder had failed to provide any documentary evidence to justify the delay. The order was passed by the commission's president and members, who emphasized that builders must adhere to their commitments and cannot arbitrarily delay projects.
