Infosys has approached a United States court to seek confirmation and enforcement of a $5 million arbitration award against US-based investment firm 777 Partners, stemming from unpaid consulting fees. The petition was filed under the US Federal Arbitration Act and the New York Convention, requesting the court to validate a final arbitration consent award issued in April by the American Arbitration Association’s International Centre for Dispute Resolution (ICDR). This information was obtained from a review of the petition by the Times of India.
Details of the Engagement
According to the court filing, 777 Partners engaged Infosys for consulting services during 2022 and 2023. The collaboration began in June 2022 through a statement of work, which was subsequently amended in October 2022 to modify deliverables and extend the project timeline until March 2023. The agreement included a clause stating that any disputes would be resolved through arbitration.
Arbitration Proceedings
Infosys initiated arbitration proceedings against 777 Partners on January 5, 2024, alleging a breach of contract. In May 2024, the ICDR appointed a three-member arbitral tribunal, consisting of Dana McGrath, Sherman Kahn, and Usher Winslett, to oversee the case. On April 10, the tribunal issued an award in favor of Infosys, based on a settlement agreement between the parties. The award directed 777 Partners to pay Infosys $5 million, along with approximately $5,998 to reimburse ICDR administrative fees and expenses that Infosys had incurred.
An email sent to Infosys seeking comment on the matter did not receive a response by the time of publication.
