DTCP Cracks Down on M3M Urbana in Gurugram for Illegal Construction and Commercial Misuse

The Department of Town and Country Planning (DTCP) in Haryana has taken decisive action against the M3M Urbana residential complex in Sector 66, Gurugram, issuing a show-cause notice to the developer and Resident Welfare Association (RWA) for alleged illegal construction and commercial misuse of designated open spaces. This enforcement drive follows a complaint lodged via the CM Flying Squad, highlighting unauthorized shops and kiosks operating in the complex's common areas, which were originally approved as open spaces.

Unauthorized Commercial Activities Uncovered

During an inspection, DTCP officials discovered multiple violations of the approved layout plan. The open area had been converted into a bustling marketplace, compromising critical safety and infrastructure standards. Specific findings included:

  • Food outlets such as Gullu's, Chaa-Chaat Chowpal, and Belgian Waffle operating without proper authorization.
  • An IndusInd Bank ATM and an illegal cricket box facility set up in the common spaces.
  • Commercial rent collection from these areas, which violates the 'Deed of Declaration' governing the property.

These activities have raised serious concerns about fire safety, ventilation, and traffic movement within the complex, posing risks to residents and visitors alike.

Legal and Safety Implications

Amit Madholia, an official from the DTCP Enforcement Wing, emphasized the gravity of the situation. He stated that the company must submit detailed documentation within 15 days, including information on illegal constructions, permissions, and approved plans. Failure to comply could result in severe consequences, such as:

  1. Sealing of unauthorized shops and structures.
  2. Further legal action under town planning norms.

The department has also summoned the concerned parties to appear before officials at the HSVP Complex in Sector 14, Gurugram, to provide necessary documents like approved building plans and occupation certificates. This step underscores the DTCP's commitment to enforcing regulations that prohibit the use of common areas in commercial properties for private or commercial purposes without prior approval.

Broader Context and Enforcement Efforts

This crackdown is part of a larger initiative by the DTCP to curb illegal constructions across Gurugram, a city grappling with rapid urbanization and regulatory challenges. The action against M3M Urbana serves as a warning to other developers and RWAs, highlighting the importance of adhering to approved plans and maintaining safety standards. By addressing such violations, authorities aim to ensure sustainable urban development and protect public welfare in the region.
