NCLT Dismisses Insolvency Petition Against Mahagun Following Settlement Agreement
In a significant development for the real estate sector, the National Company Law Tribunal (NCLT) has officially dismissed as withdrawn an insolvency petition filed by IDBI Trusteeship Services Ltd against the Mahagun real estate firm. This decision came after both parties successfully entered into a settlement agreement earlier this month, marking a pivotal resolution in a prolonged legal dispute.
Background and Legal Proceedings
The insolvency application was initially filed by IDBI Trusteeship and admitted by the tribunal on August 5 last year. However, this admission order faced a challenge before the National Company Law Appellate Tribunal (NCLAT). In a judgment dated November 6, the NCLAT set aside the original admission and remanded the matter back to the NCLT for fresh consideration, setting the stage for further legal scrutiny.
During the subsequent proceedings, Mahagun and IDBI Trusteeship reached a critical settlement agreement on February 12 this year. Following this, the financial creditor submitted an application to the NCLT, formally requesting the withdrawal of the insolvency petition. The tribunal acknowledged the settlement on record and proceeded to dismiss the company petition as withdrawn, effectively closing this chapter of litigation.
Key Details of the Tribunal's Order
The bench, comprising technical member Reena Sinha Puri and judicial member Bachu Venkat Balaram Das, noted in its order that "during the pendency of the matter… the parties entered into a settlement vide settlement agreement dated Feb 12, 2026." The financial creditor's request for withdrawal was granted, leading to the petition being "dismissed as withdrawn" on February 17.
Importantly, the order recorded that all pending applications related to the case have been disposed of. Additionally, IDBI Trusteeship secured liberty to revive the petition in the event of non-adherence to the settlement terms, ensuring ongoing accountability for Mahagun.

The closure of these insolvency proceedings is expected to bring substantial relief to homebuyers and investors associated with Mahagun Manorialle, a prominent residential project located in Jaypee Wish Town, Sector 128, along the Noida Expressway.
