TGRERA Mandates Compensation for Buyers in Undelivered Eco Township
The Telangana Real Estate Regulatory Authority (TGRERA) has issued a decisive order against Apoorva Infra, compelling the developer to provide compensation to buyers of plots in the Swaminarayana Eco Township project. Located in Undrugonda, Chivemla mandal, Suryapet district, this development has faced significant delays, prompting regulatory intervention.
Authority Acts on Multiple Complaints
On February 3, TGRERA responded to three formal complaints by issuing specific directives. In two instances, the authority ordered the promoter to pay interest for the prolonged delay in project completion. For the third complaint, a full refund with accrued interest was mandated. Apoorva Infra attributed the setbacks to the COVID-19 pandemic and ongoing legal disputes, but TGRERA found these explanations insufficient to absolve the developer of its obligations.
Refund Ordered Following Cheque Bounce Incident
One notable case involved complainant D Shivannageshwar Rao from Suryapet, who had paid Rs 4.3 lakh on June 9, 2022, representing one-quarter of the total sale consideration of Rs 17.4 lakh. Rao alleged that the project had not commenced due to disputes between the promoter and the landowner. Furthermore, a refund cheque issued by Apoorva Infra was returned unpaid due to insufficient funds.
TGRERA directed the developer to refund the full Rs 4.3 lakh with interest at 10.7% per annum, calculated from the payment date of June 9, 2022. This refund must be processed within 40 days of receiving the order. Additionally, the authority imposed a restraint on Apoorva Infra, prohibiting any advertising or sale of plots until an extension to their RERA registration is formally obtained.
Interest for Delays and Marketing Restrictions
In separate complaints filed by Syed Ayesha of Warasiguda and Syed Zeenath of Boudhanagar, both residents of Secunderabad, TGRERA noted allegations of negligible development despite a stipulated deadline of May 24, 2023. The authority directed Apoorva Infra to pay interest at 10.7% per annum on Rs 5.8 lakh in Ayesha's case. For Zeenath, the developer must pay interest on Rs 18 lakh from May 24, 2023, until the final layout is officially obtained.
TGRERA also mandated that the promoter seek an extension of their RERA registration within 15 days, reinforcing the need for compliance with regulatory standards. This series of orders underscores TGRERA's commitment to protecting homebuyer interests and ensuring accountability in the real estate sector, particularly in projects that fail to meet promised timelines.
