Negligence Case Filed After Fatal Basketball Hoop Collapse at Pune Institute

The Talegaon MIDC police in Pune have taken legal action against officials of the Tolani Maritime Institute in Indori, Maval taluka, following the tragic death of a 20-year-old student. On Wednesday, a case was registered under sections 106 (causing death by negligence) and 3(5) (common intention) of the Bharatiya Nyaya Sanhita (BNS) against the principal, manager, sports department head, and ground maintenance staffer.

Details of the Fatal Incident

The accident occurred on April 5 around 7:30 am when Vishal Verma, a second-year BTech (Marine) student from Basti district, Uttar Pradesh, was returning to his hostel after a routine workout. According to Sub-inspector Prashant Relekar of the Talegaon MIDC police, Vishal attempted to do push-ups by hanging from the rim of a basketball hoop. The pole, which was reportedly fixed about 15 years ago, could not sustain the load, leading to the entire structure collapsing onto his head.

Vishal suffered severe head injuries and was rushed to a hospital in Talegaon Dabhade. Despite medical efforts, he succumbed to his injuries around 10 am on the same day. The police had initially registered a case of accidental death but later escalated it based on a complaint filed by Vishal's elder brother, Ashok (27), who approached the authorities on Wednesday.

Complaint and Investigation Findings

In his complaint, Ashok alleged that the basketball pole was rusted and poorly maintained, directly causing his brother's death. He stated that the ground maintenance staffer, sports department head, principal, and manager of the institute were responsible for this negligence. Following the cremation, Vishal's family, including his father and other relatives, visited the institute on April 10 to meet with the principal, teachers, and students.

Sub-inspector Relekar confirmed that the police recorded statements from students and college authorities as part of their investigation. The case of causing death by negligence was formally registered based on Ashok's complaint, highlighting the alleged failure in maintaining safe campus facilities.

Institute's Response and Safety Audit

In response to the incident, Sanjeet Kanungo, the principal of Tolani Maritime Institute, announced that the management is conducting a thorough audit of the campus. Speaking on Thursday, Kanungo emphasized that student safety is the top priority. "We have started the audit of all recreational and sports activity spaces on the campus to identify dangerous spots and take corrective action. After this audit, we will rectify all the facilities that need repair or replacement," he said.

This proactive measure aims to prevent similar tragedies in the future, as the institute seeks to ensure a secure environment for its students. The case underscores broader concerns about infrastructure maintenance in educational institutions and the legal ramifications of negligence in such settings.
