UP Board Initiates Statewide Crackdown on Unauthorized Educational Institutions

The Uttar Pradesh Board of Examinations has issued a sweeping order for a statewide crackdown on unauthorized schools and illegal coaching practices, warning of stringent legal and disciplinary action against all violators. This decisive move comes in response to mounting reports from multiple districts about educational institutions operating without official recognition and teachers from recognized schools engaging in private coaching in clear violation of established regulations.

Violations of Educational Regulations and Legal Provisions

According to UP Board secretary Bhagwati Singh, these unauthorized practices represent serious breaches of multiple legal frameworks governing education in the state. "Such activities not only violate the provisions of the Right to Education (RTE) Act, 2009, but also contravene the guidelines issued by the Ministry of Education for regulating coaching centers," Singh emphasized. "This undermines academic discipline and compromises the quality of education being delivered to students across Uttar Pradesh."

The board has specifically cited several key regulations that are being violated:

  1. Regulation 18 of the UP Board mandates that any recognized institution admitting students in unapproved classes or subjects, or taking irregular admissions, will face stringent punitive action.
  2. Regulation 11(a) clearly states that admissions can only be made in approved classes and subjects after due recognition has been granted.
  3. Section 18 of the RTE Act strictly prohibits the establishment or operation of schools without proper recognition, with provisions for heavy penalties and legal proceedings against violators.
  4. Sections 2 and 4 of the Uttar Pradesh Coaching Regulation Act, 2002 explicitly bar teachers employed in recognized schools from offering services in private coaching institutes, with violations inviting strict disciplinary measures.

High Court Directives and Implementation Framework

The crackdown follows specific orders issued by the high court in PIL No. 542/2024, which directed authorities to identify all such unauthorized institutions operating across the state. In compliance with these judicial directives, the state government has established a comprehensive implementation framework through a government order dated June 9, 2025.

A high-level district committee has been formed in each district, headed by the District Inspector of Schools (DIoS), with the specific mandate to investigate cases of unauthorized educational operations. These committees will spearhead a special inspection drive scheduled to run from April 6 to April 18, 2025, during which they will systematically identify illegal schools and coaching centers and initiate necessary legal action.

Accountability Measures and Reporting Requirements

The UP Board has established strict accountability measures and reporting requirements to ensure effective implementation of the crackdown. Detailed investigation reports must be submitted by April 30, 2025, and the same documentation must be uploaded to the Board's official website at upmsp.edu.in for transparency and public access.

Secretary Bhagwati Singh issued a stern warning regarding implementation, stating that "any laxity in executing these directives will be treated as contempt of court, with district-level education officers being held directly accountable for any failures in their jurisdictions." This places significant responsibility on local education authorities to ensure thorough investigation and appropriate action against all identified violations.

The admission of students from unrecognized institutions or coaching centers has been explicitly declared illegal and punishable under the current regulatory framework. This comprehensive approach aims to restore academic integrity and ensure that all educational institutions operating in Uttar Pradesh comply with established standards and legal requirements.
