Madras High Court Denies Stay on OTT Release of Sivakarthikeyan's 'Parasakthi'
In a significant development for the Tamil film industry, the Madras High Court has delivered a major relief by refusing to impose any restraint on the digital streaming release of the highly anticipated film 'Parasakthi'. Starring Sivakarthikeyan in the lead role and directed by Sudha Kongara, the film faced legal challenges just as it was set to debut on over-the-top (OTT) platforms following its theatrical release in January 2026.
Legal Challenge and Court's Decision
The controversy arose when assistant director Varun Rajendran filed a lawsuit alleging that the core idea and background of 'Parasakthi' were copied from his original work titled 'Semmozhi'. According to reports from The Hindu, Rajendran claimed that the film's narrative was derived from his story, prompting him to seek an immediate interim stay to block its OTT release.
However, Justice Senthilkumar Ramamoorthy of the Madras High Court declined to pass any orders halting the release. The court has scheduled the next hearing for February 9, 2026, allowing the film to proceed with its digital debut without legal obstruction at this time. This decision has been welcomed by the film's crew, producers, and a vast fanbase eagerly awaiting its streaming availability.
Producers' Strong Defense Against Plagiarism Claims
In response to the allegations, the production house Don Pictures filed a detailed reply in court, vehemently defending the originality of 'Parasakthi'. The producers argued that the film is set against the backdrop of the anti-Hindi agitation of 1965 in Tamil Nadu, which they described as a historical fact that cannot be copyrighted or claimed as proprietary.
They emphasized that historical events and movements belong to the public domain and society at large. While acknowledging the film's setting in that era, the makers clarified that all characters, dialogues, screenplay, and scenes are entirely fictional and creatively written. The producers firmly rejected the plagiarism claim, stating that 'Parasakthi' does not copy any personal story or private work and stands as an independent and original creation.
Current Status and Future Proceedings
With the court's refusal to grant an interim stay, there is currently no legal barrier to the OTT release of 'Parasakthi'. The film is now available for streaming, much to the delight of fans who have expressed relief and support for the court's stance. However, the legal battle is far from over, as the case will continue with further hearings.
Final clarity on the plagiarism allegations will only emerge after subsequent court proceedings. Until then, the film industry and audiences remain hopeful that 'Parasakthi' will continue to entertain without hindrance. This case highlights the delicate balance between creative expression and intellectual property rights in the entertainment sector.
