Music Maestro Ilaiyaraaja Takes Legal Stand Against Unauthorized Use of His Identity
The long-running dispute over the unauthorized exploitation of music legend Ilaiyaraaja's name, image, and persona has taken a fresh turn. Ilaiyaraaja recently approached the Madras High Court seeking legal protection. He wants to stop the alleged misuse of his photograph, name, voice, and the honorary title 'Isaignani' across various social media platforms.
The celebrated composer expressed deep concern over the rampant exploitation of his persona without his consent. Platforms like YouTube, Facebook, X, and Instagram feature numerous reels, memes, and videos that use his identity. Some of this content carries offensive connotations. Ilaiyaraaja has requested the court to order the removal of such material. He also seeks disclosure of any revenues generated from these unauthorized activities.
Sun Television Network Challenges the Court's Restraining Order
In a significant development, Sun Television Network Limited has filed an appeal with the Madras High Court. The broadcaster is challenging the interim restrictions imposed by the court. These restrictions currently bar the use of Ilaiyaraaja's name and photograph.
According to reports, Sun TV argues that this blanket restraint severely impacts its operations. The network contends it hampers their ability to telecast films and other content featuring the composer's work. Sun Television maintains that using Ilaiyaraaja's name or image while broadcasting songs or films does not violate his personal or proprietary rights. They assert such usage is an intrinsic and necessary part of film exhibition and promotion.
Background of the Legal Case and Previous Court Observations
The original case was filed by Ilaiyaraaja against several parties. These included various YouTube channels, music companies, and social media platforms. During an earlier hearing, Justice Senthil Kumar questioned the nature of the prejudice allegedly suffered by the composer.
The plaintiff's counsel argued that third parties were commercially profiting from Ilaiyaraaja's name and image. This, they claimed, constituted a clear infringement of his right to publicity and his right to privacy. The court found these arguments prima facie acceptable.
Consequently, on November 21 of last year, the court issued an interim order. This order restrained the unauthorized use of Ilaiyaraaja's photograph on social media platforms.
Broadcaster Seeks Legal Clarification and Relief
In its current appeal, Sun Television has urged the court to provide clarification. The network wants assurance that the restraint order does not apply to the lawful broadcast of Ilaiyaraaja's songs, films, or related material.
Sun TV argues the court's order is overly broad in its scope. They state it unnecessarily interferes with their standard broadcasting procedures. The broadcaster contends it is unclear how using a composer's image or name in connection with content he created could violate his rights.
