Election Commission Implements Strict Ban on Exit Polls for Five State Elections

The Election Commission of India has issued a decisive directive prohibiting the conduct and dissemination of exit polls for the upcoming assembly elections in five states. This ban is effective from 7:00 AM on April 9 until 6:30 PM on April 29, 2024.

Legal Framework and Penalties for Violations

According to the poll body, any activity involving exit polls during this specified period constitutes a violation of Section 126A of the Representation of the People Act, 1951. Offenders face severe legal consequences, including imprisonment for up to two years, substantial fines, or both penalties combined.

This regulatory move is a standard procedural measure designed to uphold electoral integrity. By preventing the release of exit poll data, the Commission aims to ensure fairness and eliminate any potential influence on voter behavior during the critical election process.

Detailed Election Schedule and Polling Phases

The notified election schedule outlines the polling dates as follows:

  • Assam, Kerala, and Puducherry: Voting will be held on April 9, 2024.
  • Tamil Nadu: Polling is scheduled for April 23, 2024.
  • West Bengal: Elections will occur in two phases on April 23 and April 29, 2024.

The counting of votes for all five states is officially set for May 4, 2024, marking the conclusion of the electoral process.

Silence Period Regulations and Campaigning Restrictions

In alignment with the exit poll ban, the Election Commission has also enforced the mandatory 48-hour 'silence period' before polling concludes in each region. This period commences at different times:

  1. In Kerala and Puducherry, the silence period starts at 6:00 PM on Tuesday.
  2. In Assam, it begins at 5:00 PM on the same day.

The silence period signifies the end of all campaigning activities 48 hours prior to the closing of voting in a constituency or the entire state. Under Section 126(1)(b) of the Representation of the People Act, the display of any election-related content, including opinion poll results, on electronic media is strictly restricted during this interval.

Permitted activities are limited to door-to-door campaigning by a small number of party workers or candidates. However, in today's digital era, enforcing these restrictions presents significant challenges for authorities.

Polling Hours and Operational Adjustments

Typically, voting is conducted from 7:00 AM to 6:00 PM across polling stations. However, these timings may vary based on local factors such as terrain conditions and security situations, ensuring accessibility and safety for all voters.

The Election Commission's comprehensive measures underscore its commitment to conducting free, fair, and transparent elections, safeguarding the democratic process from undue external influences.
