Election Commission Clarifies Timing of Model Code of Conduct

The Election Commission of India on Sunday issued a crucial clarification regarding the timing of government announcements in relation to elections. The panel stated that announcements and policy decisions made before the official declaration of election dates remain the legitimate prerogative of the government in office, whether at the Centre or state level.

When Does the Model Code Actually Apply?

The model code of conduct, which prohibits governments from making any new announcements or policy decisions that could influence voters, comes into effect strictly from the moment the Election Commission officially announces the election schedule. This clarification was provided by the Commission while declaring the assembly poll schedules for West Bengal, Tamil Nadu, Assam, Kerala, and the union territory of Puducherry.

Chief Election Commissioner Gyanesh Kumar addressed specific questions about whether announcements made by West Bengal Chief Minister Mamata Banerjee less than an hour before the EC's poll schedule announcement constituted a violation. "The model code of conduct comes into effect after the announcement of polls and not before," Kumar stated unequivocally.

Historical Context of Pre-Poll Announcements

This practice of incumbent governments making significant announcements just before the code kicks in has historical precedent. Opposition parties have frequently criticized such moves, labeling them as "inducements" designed to sway voter sentiment. On Sunday, reporters highlighted several recent examples:

  • The Nitish Kumar government in Bihar extended Rs 10,000 in financial assistance to women just before the 2025 assembly elections
  • The M.K. Stalin government in Tamil Nadu deposited approximately Rs 6,550 crore into the bank accounts of over 1.3 crore women as recently as February

The West Bengal Dearness Allowance Announcement

West Bengal Chief Minister Mamata Banerjee, who also serves as the Trinamool Congress chief, announced dearness allowance for thousands of state government employees via social media platform X. She stated that employees "will start receiving their ROPA 2009 DA arrears from March 2026 onwards as per the modalities detailed out in notifications issued by our finance department."

This announcement drew immediate criticism from the opposition. Bengal BJP leader Suvendu Adhikari responded on X, calling the DA announcement a "joke" and accusing the TMC government of "desperate last-minute poll gimmick" after years of what he described as financial mismanagement. Adhikari's post read: "After years of looting the state treasury and cheating them blind, this is your desperate last-minute poll gimmick? Zero accountability, zero funds, zero delivery... Classic TMC poll drama."

Broader Implications for Electoral Process

The Election Commission's clarification establishes a clear boundary in the electoral timeline. While governments retain the right to govern and make policy decisions until the official announcement of elections, the model code of conduct creates a level playing field once elections are formally declared. This distinction aims to balance governance continuity with electoral fairness during the sensitive pre-poll period.
