Assam Information Commission Imposes Rs 30,000 Penalty for RTI Act Non-Compliance
Silchar: In a significant ruling underscoring the enforcement of transparency laws, the Assam State Information Commission has levied a penalty of Rs 30,000 on SA Islam, the district social welfare officer of Sribhumi district. This action was taken due to the officer's failure to furnish information requested under the Right to Information (RTI) Act, marking a stern response to procedural lapses.
Details of the Case and Commission's Order
The order was issued by State Information Commissioner Utpal Baruah on March 10, following a hearing on a complaint filed by Nirupam Banerjee, a resident of Silchar. Banerjee had sought specific information from the office of the district social welfare officer using the RTI Act, but the response was allegedly inadequate and unsatisfactory, prompting him to escalate the matter to the commission.
During the proceedings, the commission observed that despite multiple opportunities, Officer SA Islam could not adequately justify the delays and deficiencies in providing the requested information. The commission also identified procedural irregularities in how the RTI application was handled and the responses were submitted by the department.
Commission's Findings and Penalty Imposition
After a thorough examination of the records and submissions, the commission held Officer Islam responsible for violating key provisions of the RTI Act. Consequently, a penalty of Rs 30,000 was imposed. The commission directed the officer to deposit this amount under the account head "Receipt under RTI Act" via the eGRAS portal within 30 days and to submit a copy of the receipt to the commission for verification.
This decision highlights the commission's commitment to upholding the principles of transparency and accountability in governance. It serves as a reminder to public officials of their obligations under the RTI Act to provide timely and accurate information to citizens.
