The Wokha district administration in Nagaland has issued an immediate order for the rigorous enforcement of the Noise Pollution (Regulation and Control) Rules, 2000. This directive aligns with mandates from the National Green Tribunal, the Central Pollution Control Board, and the Nagaland Pollution Control Board, aiming to curb excessive noise and protect public health.
Key Provisions and Penalties for Violations
Under the 'Polluter Pays' principle, the order establishes a detailed compensation scale for non-compliance. It urges the public, event organizers, and businesses to adhere promptly to maintain peace and tranquillity in the district.
Loudspeakers and Public Address Systems: Written permission from the district administration is now mandatory for using loudspeakers or public address systems. Their operation is strictly banned from 10 PM to 6 AM and in designated silence zones. Violators face a fine of Rs 10,000 and immediate seizure of equipment.
Diesel Generator Sets: All diesel generators must meet prescribed noise standards. Penalties vary based on capacity:
- Sets up to 62.5 KVA: Rs 10,000 fine and equipment sealing.
- Sets between 62.5 KVA and 1000 KVA: Rs 25,000 fine and equipment sealing.
- Sets above 1000 KVA: Rs 1 lakh fine and equipment sealing.
Construction Equipment and Firecrackers: Sound-emitting construction equipment is prohibited during nighttime in residential areas and silence zones, with fines of Rs 50,000 and equipment seizure. Firecrackers are strictly banned in silence zones and at night, reinforcing Supreme Court time limits.
Escalating Penalties for Repeat Offenders
The order emphasizes stricter consequences for repeated violations. Fines will double for second offenses and triple for third offenses, followed by permanent withdrawal of permission to operate equipment or premises.
