Ahmedabad: A local court in Ahmedabad has ordered a practicing advocate to pay Rs 30,000 per month as maintenance to his estranged wife and daughter. The woman has also accused her husband and in-laws of domestic violence.
Marriage and Separation Details
The couple married in 2010 and have one daughter. They have been living separately for the past ten years. The wife left the matrimonial home alleging harassment by her husband and in-laws. She later filed a divorce petition, which was dismissed by a family court.
Legal Proceedings Under Domestic Violence Act
The woman filed a complaint with a magisterial court under the Protection of Women from Domestic Violence Act, seeking Rs 50,000 per month as interim maintenance for herself and her minor daughter. She submitted that her husband is a reputed lawyer with a healthy practice and owns multiple properties, including a flat and five shops in Mumbai, as well as ancestral agricultural land in Rajasthan. She further claimed that he earns well from renting his properties.
Court's Decision
After hearing the woman's counsel, the court noted that the case might take a long time to conclude and that it was in the interest of justice to award a lump sum amount for interim maintenance. The court ordered the lawyer to pay Rs 30,000 per month towards the wife's maintenance, the daughter's education expenses, and house rent.
This order provides immediate financial relief to the wife and child while the legal proceedings continue.
