Ahmedabad NDPS Court Imposes 12-Year Sentence for Drug Possession

A special NDPS court in Ahmedabad delivered a stern verdict on Monday, sentencing a man to 12 years of rigorous imprisonment and imposing a fine of Rs 2 lakh for possession of mephedrone in a commercial quantity. The convict, identified as Mohammed Salim Shaikh, a resident of Bapunagar, was found guilty under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

Arrest and Seizure Details

The case dates back to March 26, 2024, when the Special Operations Group (SOG) of the crime branch acted on a tip-off regarding Shaikh's involvement in the sale of contraband within the city. He was apprehended from a shop near the Ajit Mill compound, where authorities seized 82 grams of MD drug, commonly known as mephedrone, from his possession. This arrest was part of a broader crackdown on drug trafficking activities in Ahmedabad.

Legal Proceedings and Evidence

During the trial, Additional Public Prosecutor D M Thakor played a pivotal role in presenting the prosecution's case. He examined a total of 17 witnesses and submitted 35 documents as evidence to firmly establish Shaikh's guilt. Notably, Shaikh did not hire a private lawyer and instead received legal aid from the legal services authority, which provided him with representation throughout the proceedings.

Court's Rationale and Sentencing

After a thorough trial, Special NDPS Judge V B Rajput of the city sessions court considered the commercial quantity of the contraband involved. In his sentencing remarks, Judge Rajput emphasized the severe impact of drug trafficking on society. He stated, "In present times, drug trafficking is a very serious and challenging issue. Many families are destroyed because of such accused who run drug rackets. Teenagers going to school and college ruin their youth due to addiction to such substances. In this way, the youth of the country is being ruined." This statement underscored the court's commitment to deterring such crimes through stringent penalties.

The court's decision reflects a growing judicial focus on combating the drug menace, particularly in urban areas like Ahmedabad, where such offenses can have devastating social consequences. The imposition of both imprisonment and a substantial fine aims to serve as a deterrent to others involved in similar illegal activities.
