In a significant ruling, a special POCSO judge at the Ahmedabad city sessions court on Tuesday handed down a 3-year prison sentence and imposed a Rs 50,000 fine on a private tuition teacher for the sexual harassment of an 11-year-old girl. The case involved the accused, now 29 years old, demanding obscene photographs from the minor through messages on a mobile phone application.

The accused was employed with a leading coaching institute in Ahmedabad at the time of the incident. The matter came to light when the victim's parent filed a formal complaint, leading the Maninagar police to register an FIR in July 2023. According to the charges, the teacher used Snapchat to send messages to the minor student, demanding photographs and issuing threats if she failed to comply. Upon receiving the complaint, the coaching institute promptly terminated his employment.

Following a thorough investigation, the police charged the accused under relevant sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. Additional public prosecutors K G Jain and D M Thakor presented the case in court, examining eight witnesses and submitting thirteen pieces of documentary evidence to establish the teacher's guilt beyond reasonable doubt.

Court's Ruling and Rationale

Special POCSO judge A B Bhatt, in delivering the verdict, emphasized the severity of the offense. The court ordered that the Rs 50,000 fine be provided to the victim as compensation, highlighting the need for redressal in such cases. Judge Bhatt stated, "The sexual harassment of a child even through an electronic means cannot be treated lightly as it has the potential to cause a deep mental impact on the child."

In its detailed order, the court noted that the accused, being in a position of trust and authority as a teacher, misused his role by engaging in harassment through electronic communication. The demand for photos created a sexually suggestive image of the victim, who, as a minor, was unable to fully comprehend the implications. The court further warned, "If the communication remained undiscovered, the consequences would be more serious and would cause more harm to the child's wellbeing."

Concluding that the act warranted strict punishment, the court asserted, "Therefore, the act of the accused shall not be treated with leniency, and the punishment prescribed under the provisions is required to be imposed. Moreover, considering the position of the accused as a teacher, this Court is of the view that proper punishment and lesson is required to be awarded." This ruling underscores the judiciary's commitment to protecting children from digital exploitation and holding perpetrators accountable under the POCSO Act.
