Background of the Case

The case originated from a writ petition filed by Ahsan Ali, a resident of Muzaffarnagar. Ali, who claims to be the lawful owner of a plot of land in a village, purchased the property from Praveen Kumar Jain in 2019 through a registered sale deed. He alleged that authorities sealed a mosque constructed on his land after he began raising a boundary around it. The authorities justified the action by stating that the construction was illegal and lacked prior permission.

According to Ali's counsel, no notice or opportunity for a hearing was provided before the sealing of the premises. This lack of due process prompted the court to intervene and seek clarity from the state government.
