AP High Court Mandates Former Intelligence Chief's Cooperation in Custodial Torture Investigation
The Andhra Pradesh High Court issued a significant directive on Friday, ordering former intelligence chief P S R Anjaneyulu to fully cooperate with the ongoing police investigation into an alleged custodial torture case involving K Raghu Ramakrishna Raju. The court emphasized that Anjaneyulu must appear before the investigating officer whenever required to assist with the probe.
Court Grants Interim Relief Amid Medical Bail Concerns
While mandating cooperation, the high court also provided interim relief to Anjaneyulu, who is currently on medical bail in a separate case. The court explicitly directed the police to refrain from taking any coercive steps during the questioning process. This decision balances the need for investigative progress with considerations for the accused's health and legal rights.
Background of the Case and Legal Arguments
The case originated from a complaint filed by Raghu Ramakrishna Raju, who serves as the present deputy speaker and was formerly a Member of Parliament. The complaint, registered by Nagarampalem police in Guntur, alleges that Anjaneyulu, along with other senior officers from the Criminal Investigation Department (CID), was involved in his custodial torture. Anjaneyulu subsequently approached the high court seeking anticipatory bail to preempt potential arrest.
During the proceedings, senior counsel Posani Venkateswarlu, representing the police, informed the court that another accused officer, Sunil Naik, had been granted an exemption from appearing before the investigating officer until March 22. Venkateswarlu argued that the police need to question both Anjaneyulu and Naik together to ensure a thorough and coordinated investigation, requesting additional time to submit detailed arguments.
On behalf of Anjaneyulu, counsel Abhay Siddhanth highlighted concerns about the threat of arrest and sought interim protection until the matter is fully resolved. After carefully considering arguments from both sides, Justice Venkata Jyothirmayee Pratapa delivered the ruling, instructing Anjaneyulu to comply with police summons and simultaneously safeguarding him from coercive measures.
Implications for the Investigation and Legal Precedents
This ruling underscores the judiciary's role in overseeing sensitive investigations involving high-profile individuals. By ordering cooperation while preventing coercive actions, the court aims to facilitate a fair and transparent inquiry into the serious allegations of custodial torture. The case continues to draw attention due to its implications for police accountability and human rights protections in Andhra Pradesh.
