Bhuj Court Imposes Death Penalty for Brutal Rape and Murder of Elderly Woman
A court in Bhuj, Gujarat, has delivered a powerful verdict by sentencing a 24-year-old man to death for the horrific rape and murder of a 65-year-old woman in 2023. In a judgment steeped in cultural and spiritual references, the court invoked Hindu scriptures, emphasizing that a soul attains liberation only after justice is served.
Details of the Heinous Crime
The convict, identified as Sachin Mavji, also known as Mavo Kuvriya, committed the crime on the intervening night of February 22 and 23, 2023, near Ratadiya village. The victim, who was on her way to a temple, was kidnapped by Mavji on his motorcycle. He subsequently raped and murdered her in a brutal, unprovoked attack.
Special Judge (POCSO) J A Thakkar found Mavji guilty under multiple sections of the Indian Penal Code, including Section 302 for murder, Section 376(A) for rape resulting in death, and Section 364 for kidnapping. The judge ordered that the convict "be hanged by the neck till he is dead," marking a stern judicial response to the atrocity.
Compelling Evidence Presented in Court
The prosecution built a strong case with irrefutable evidence. Key pieces included CCTV footage showing the victim riding pillion on Mavji's bike, a postmortem report confirming death by asphyxia due to smothering, and DNA profiling that matched blood samples from both the accused and the victim. The investigation was meticulously conducted by the Pragpar police station team.
Assistant Public Prosecutor D J Thacker argued that this case fell into the "rarest of rare" category, given its brutal, barbaric, and completely unprovoked nature. Thacker highlighted that the accused's actions demonstrated a depraved mindset and posed a grave threat to society, warranting the maximum punishment.
Court's Spiritual and Societal Observations
In its order, the court delved into Hindu beliefs, stating, "According to Hindu scriptures, it is believed that the soul of a victim or deceased person, especially one who has suffered a cruel crime like murder, does not attain peace until a proper, just and effective judicial decision is made in the case. Only then can the soul receive true liberation and peace, as per our Hindu beliefs and traditions."
The court further noted that the victim, an elderly woman, was akin to a mother figure in Hindu society, often revered as a divine presence. The crime was committed on land considered pious due to blessings of Mata Ashapura and Amba Mata, adding to its gravity. "How can such an incident involving a mother be taken lightly?" the judge questioned, underscoring the cultural significance of respecting elders.
Raising Concerns Over Women's Safety
The judgment also addressed broader societal issues, particularly women's safety. The court wondered, "Are elderly women not safe?" noting that such incidents raise troubling questions in ordinary families and often lead to restrictions on women's independence.
It observed that crimes against women instill fear in families, causing them to hesitate in allowing women to step out alone. This constant fear curtails women's freedom, forcing them to live under restrictions and hindering their ability to engage in activities or work independently. "When women's development is hindered in this way, the country's development is also stalled," the court remarked, adding that while women are regarded as symbols of strength, such incidents contradict that belief and cannot be taken lightly.
