Bombay High Court Grants Bail to Dismissed Police Sub-Inspector in Satara Doctor Case
The Bombay High Court's Kolhapur bench has granted bail to a dismissed police sub-inspector (PSI) who was arrested in connection with the alleged rape and abetment of suicide of a 28-year-old doctor from Phaltan sub-district hospital in Satara district. The incident dates back to October 2025, and the court's decision, delivered on April 1, has sparked significant legal and public interest.
Court Cites Relationship and Lack of Evidence in Bail Order
Justice Sachin S Deshmukh, presiding over the bench, carefully reviewed submissions from both sides and the official record, including the chargesheet. The court observed that the evidence indicated the applicant PSI and the survivor were in contact with each other, with WhatsApp chats suggesting a relationship that had turned sour.
"Moreover, prima facie, there is dearth of material on record to indicate the proximate and compelling reasons attributable to the applicant at the time of alleged incident," the bench stated in its order. The court further noted, "It is pertinent to note that apart from the suicide note, implicating the applicant regarding the offence of rape, there is absence of detailed allegation or time of the incident. Given that the applicant and the deceased were in relation with each other, the alleged act of physical relations, if any, cannot be prima facie treated as non-consensual."
Background of the Case and Investigation Details
The tragic incident unfolded on October 23, 2025, when the doctor was found dead in a hotel room near the hospital. She was discovered hanging by a dupatta tied to a ceiling fan. A note, purportedly written on her palm, named the PSI and another man—the son of her landlord—as responsible for driving her to suicide by subjecting her to physical and mental harassment over the previous five months.
Based on this note and other evidence, including WhatsApp chat exchanges, the police filed a First Information Report (FIR) under sections 64 (rape) and 108 (abetment of suicide) of the Bharatiya Nyaya Sanhita (BNS) against both accused individuals. A Special Investigation Team, led by senior IPS officer Tejaswini Satpute, conducted the investigation and subsequently filed the chargesheet.
Legal Proceedings and Conditions of Bail
The court emphasized that the investigation has been completed and the chargesheet filed. However, given the list of witnesses, the trial is unlikely to commence and conclude within a reasonable period, which influenced the bail decision. The dismissed PSI was released from Satara jail after furnishing a personal bond of Rs 50,000 and fulfilling other conditions stipulated by the High Court.
Advocate Girish Wani, representing the dismissed PSI, confirmed the release and outlined future legal steps. "We will now file an appeal before the state home secretary against the Special Inspector General (Kolhapur Range) Sunil Phulari's order of November 5, 2025, that dismissed our client from service," Wani stated. He added, "There was no notice, no enquiry before the dismissal. It was initiated only upon the filing of an FIR. The HC's bail order makes our case a little stronger."
Court Imposes Strict Conditions and Ongoing Proceedings
The High Court has imposed several stringent conditions on the dismissed PSI as part of the bail grant:
- He is restrained from putting any pressure on prosecution witnesses.
- He must not tamper with prosecution evidence.
- He is required to attend the trial on every date unless exempted by the trial court.
Meanwhile, the bail application for the co-accused—the engineer son of the deceased doctor's landlord—is currently underway at Phaltan's sessions court. He faces similar charges under the BNS for rape and abetment of suicide, highlighting the complexity and sensitivity of this case as legal proceedings continue to unfold.
