A local court in Hyderabad has dismissed the bail petition of a CISF constable accused of raping a woman whom he had hired for domestic work. The incident occurred on May 9, and the case was registered at the Pahadishareef police station in the second week of May.
Court Proceedings
The XIII Additional District and Sessions Judge at LB Nagar rejected the bail plea of the 38-year-old accused on May 20. The judge observed that the accused had committed a grave offense and that releasing him on bail could hamper the investigation.
Prosecution's Argument
According to the prosecution, the victim, a daily-wage laborer in her 30s, was waiting for work at Shamshabad on the morning of May 9. An unknown man approached her and offered house-cleaning work for ₹1,000. He then took her to his residence in a residential area under the Pahadishareef police station limits on a two-wheeler.
The woman alleged that after she began cleaning, the accused forced her to consume liquor and subsequently raped her. He also threatened her not to disclose the incident to anyone. The accused then offered to drop her home but pushed her off the two-wheeler near a school in Shamshabad and fled, causing her injuries.
The additional public prosecutor argued that bail should not be granted as a potency test and test identification parade are yet to be conducted, and forensic reports are still awaited.
Defense's Counter
The counsel for the accused contended that the allegations were false and that his client, being a government employee with a fixed address, was unlikely to abscond. However, the court was not convinced.
Court's Order
In its order, the court stated: 'As the investigation is under progress, if being released on bail, there is every likelihood of threatening the victim or making the evidence disappear or he may abscond and cause hurdles to the investigation. As such, the accused does not deserve to be released on bail at this juncture.'
