Kanpur Lamborghini Crash: Court Dismisses Driver's Surrender Plea Amid Police Dispute
In a significant development in the Kanpur Lamborghini Revuelto case, a district court has rejected a surrender application filed by a 45-year-old man, Mohan, who claimed he was driving the luxury car during the accident that injured a person and damaged multiple vehicles on Sunday evening. The court's decision came as police investigations firmly pointed to Shivam Mishra, son of tobacco tycoon K K Mishra, as the driver at the time of the incident.
Court Proceedings and Police Statements
Prosecuting Officer Nagendra Kumar Mishra detailed that two applications were considered by the court on Wednesday. The first was Mohan's request to be taken into judicial custody in connection with the case, while the second sought the release of the seized Lamborghini vehicle. The court declined to take Mohan into custody, noting that police reports indicated he was neither wanted in the case nor had his name emerged during the ongoing probe.
According to the Prosecuting Officer, police informed the court that their investigation has established Shivam Mishra as the driver when the accident occurred. Regarding the vehicle release plea, the court directed police to submit a technical examination report and instructed the vehicle owner to provide all relevant documents for verification before any further consideration.
Conflicting Accounts and Ongoing Investigations
K K Mishra, the tobacco supplier and father of Shivam, had earlier claimed to media that both his son and the driver were in the vehicle. He stated that the driver was on a trial run when Shivam suddenly fell unwell, leading to an emergency brake and a subsequent collision with a tempo. Advocate Dharmendra Singh, representing the driver and vehicle owner, added that Shivam is currently undergoing treatment in Delhi.
However, police have denied this version. Deputy Commissioner of Police Atul Kumar Srivastava asserted that their probe has conclusively identified Shivam as the driver, with Mohan not figuring in their investigations. A technical examination of the vehicle is pending, and police plan to serve a notice to Shivam to appear before the investigating team to record his statement and formally join the probe.
Background of the Incident
The case originated from a complaint filed by Taufeeq, a man injured in the incident, leading to an FIR against an unidentified person under sections including rash and negligent driving. Police have noted that they will examine claims of Shivam's medical issues as part of their comprehensive investigation. The Lamborghini, owned by K K Mishra, remains seized by Gwaltoli police station as authorities continue to gather evidence and clarify the circumstances surrounding the crash.
