Court Sentences Man to 20 Years for Child Rape, Notes Alarming Rise in Abuse Cases
A court in Chhota Udepur has handed down a 20-year prison sentence to a man convicted of raping a 14-year-old girl, while also highlighting a disturbing trend of increasing sexual exploitation of children, particularly cases involving relatives. The court emphasized that such incidents must be addressed with utmost sensitivity, as victims often endure the trauma of recounting their painful experiences multiple times to various authorities.
Case Details: Kidnapping and Repeated Assault
In 2023, the parents of the 14-year-old victim filed a formal complaint at the Jetpur Pavi police station in Chhota Udepur against Bharmesh Nayka, a labourer. They accused him of kidnapping their daughter and subjecting her to repeated rape. According to the complaint, after abducting the girl, Nayka took her to locations in Bhuj and Rajkot, where he sexually assaulted her on multiple occasions.
Police investigators successfully tracked down Nayka and placed him under arrest. During the proceedings, the accused claimed to be in a relationship with the minor girl. However, as she was underage, she was legally incapable of providing consent, a critical factor in the case.
Legal Proceedings and Conviction
Public Prosecutor R S Parmar stated that the court meticulously reviewed all evidence presented before convicting Nayka under the stringent provisions of the Protection of Children from Sexual Offences (Pocso) Act. The court considered the severity of the crime and the vulnerability of the child victim in reaching its decision.
Special Pocso Judge Jaspritsingh Bagga pronounced the sentence, imposing 20 years of rigorous imprisonment on Nayka. In addition to the prison term, the court ordered that compensation of Rs 4 lakh be paid to the victim to aid in her recovery and future well-being.

In its ruling, the court made significant observations regarding the broader issue of child sexual abuse. It noted that incidents of sexual exploitation of children are on the rise, with a particular increase in cases where the perpetrator is a relative.
