Delhi Court Imposes Life Sentence for Heinous Child Murder Case

A court in New Delhi has delivered a stern verdict, sentencing a 34-year-old man to life imprisonment for the brutal sodomy and murder of an 11-year-old boy in 2019. The court strongly condemned the act, stating that the convict's conduct demonstrated a criminal mentality that required dealing with "with an iron hand."

Court Rejects Death Penalty Despite Heinous Nature of Crime

Additional Sessions Judge Amit Sahrawat, while acknowledging the extreme gravity of the offences, declined to award the death penalty. The judge noted that although the crimes were undeniably heinous, they did not fall within the judicial classification of the "rarest of rare category" that typically warrants capital punishment.

The court expressed profound sympathy for the victim's parents, emphasizing that "the loss of their only child aged about 11 and a half years, and that too in the circumstances when he was brutally molested and murdered, is not bearable for any parent." Adding to their tragedy, the parents revealed they had previously lost a daughter to pneumonia and were now medically unfit to conceive another child.

Detailed Account of the 2019 Crime

Special Public Prosecutor Aditya Kumar presented evidence showing that on January 2, 2019, the convict, identified as Singh, had taken the minor boy to an isolated location near a railway line. There, he first committed an unnatural sexual offence against the child before proceeding to slit the boy's throat, resulting in his death.

The court firmly stated that "the age of the convict cannot justify his misdeeds" and that "the convict does not deserve the benefit of any factor in his favour." In its March 14 order, the judge observed that neither Singh's age nor the fact that this was his only criminal case could alleviate the immense suffering inflicted upon the victim's parents.

Legal Sentencing and Compensation Details

The court sentenced Singh to life imprisonment under the Protection of Children from Sexual Offences Act (POCSO) and for murder charges. Additionally, he received seven years of rigorous imprisonment for kidnapping the minor.
