Delhi High Court Upholds Public Interest in Land Dispute, Greenlights Road Expansion
In a landmark decision, the Delhi High Court has emphatically ruled that the interests of individuals encroaching on public land must be subordinated to the broader public good. This ruling paves the way for the government to proceed with a critical road-widening initiative in Shalimar Bagh, aimed at alleviating traffic congestion and enhancing access to essential services.
Court Grants Deadline for Vacating Acquired Land
A bench comprising Justices Prathiba M Singh and Madhu Jain issued a recent order authorizing a demolition drive for the expansion of a public road. The court has provided occupants residing on the acquired land in Haiderpur village with a grace period until May 30 to vacate the premises. This decision came in response to a petition filed by Saroj, a resident of Shalimar Bagh, representing approximately 98 occupants.
The bench underscored that infrastructural projects, particularly those facilitating access to medical care, education, and fire safety, should not face further delays. "The expansion of infrastructural projects, especially those concerning access to essential services such as medical care, education and fire safety, ought not to be delayed any further, as such delay would be detrimental to the larger interests of the residents of Shalimar Bagh," the court observed. It stressed that private encroachments on public land must yield to the public interest, including improved traffic flow in the area.
Petitioners' Claims and Government's Stance
The petitioners contested the proposed demolition and dispossession, arguing that several families had inhabited the land for decades and would face homelessness if evicted. However, authorities informed the court that the land was acquired long ago, and previous legal challenges to the acquisition had been dismissed by the high court, with the Supreme Court also declining intervention.
Acknowledging the prolonged occupation, the court granted residents until May 30 to vacate, directing that no demolition or dispossession occur before this deadline. Additionally, it urged the Delhi government to consider sympathetically the residents' request for ex gratia compensation.
Road Widening Project Details and Future Steps
The Delhi government emphasized that the road widening is essential to enhance traffic flow and ensure unimpeded access for emergency vehicles, such as ambulances, to nearby hospitals and schools. "Upon the expiry of the aforesaid period, the respondents are at liberty to proceed with the expansion of Road No. 320 and remove all encroachments and unauthorised constructions," the court stated, adding that occupants would not be displaced until the deadline, provided they cooperate.
This ruling reinforces the principle that public infrastructure development takes precedence over individual encroachments, setting a precedent for similar cases in urban planning and land use disputes across the capital.
