Delhi Police Invokes Stringent PITNDPS Act to Crack Down on Drug Trafficking Networks
In a significant move to combat narcotics distribution, Delhi Police has invoked the stringent Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PITNDPS) Act against two alleged traffickers. This action aims to weaken the network of active drug distributors operating across the city, targeting individuals with extensive criminal histories.
Preventive Detention Under PITNDPS Act: A Tough Legal Measure
Under the PITNDPS Act, a suspect can be preventively detained for up to 12 months without trial, making it exceptionally difficult for alleged drug traffickers to secure bail. This provision is approved by an advisory board that includes high court judges, ensuring judicial oversight. The detention orders were issued on February 26 under Section 3(1) of the Act, following a thorough examination of the criminal backgrounds and alleged ongoing involvement of the accused in narcotics trafficking.
Accused Identified: Details of the Detained Traffickers
The accused have been identified as Vijay Kumar, a 47-year-old resident of Nand Nagri, and Vikas, a 29-year-old from Najafgarh. Both are currently lodged in Tihar Jail following the detention orders. According to police, the proposals for preventive detention were prepared by the anti-narcotics task force (ANTF) of the crime branch and forwarded to the PITNDPS division of the revenue department under the Union finance ministry.
Criminal Histories: Extensive Records of the Accused
DCP (ANTF) Rahul Alwal provided detailed insights into the criminal histories of the accused. Vijay Kumar has a criminal history dating back to 1992 and is listed as a ‘bad character’ at Nand Nagri police station. He has been involved in approximately 50 criminal cases, including offences related to murder, snatching, excise violations, and drug trafficking. Kumar's involvement in the narcotics trade first surfaced in 2007 when he was arrested in a case registered at Nand Nagri police station. More recently, he was arrested by ANTF last year, when 726 grams of heroin was found on him and his associates in a case registered by the crime branch.
Vikas, the second accused, entered the drug trade in recent years. He first came under police scrutiny in 2022 when he was arrested with 54 grams of amphetamine in a crime branch case that also invoked provisions of the Foreigners Act. He was again arrested by ANTF last year, when 61 grams of MDMA was seized from him and his associates.
Police Strategy: Disrupting Drug Networks and Seizing Assets
Police stated that both men were detained under the PITNDPS Act to prevent them from continuing their alleged involvement in illicit drug trafficking. This move is part of a broader crackdown on narcotics in Delhi. Along with strict legal action against traffickers, police are also identifying and initiating proceedings to seize properties allegedly acquired through the proceeds of drug trafficking. This multi-pronged approach aims to dismantle the financial foundations of drug networks and deter future criminal activities.
The invocation of the PITNDPS Act highlights the authorities' commitment to using all available legal tools to combat the drug menace in the capital. By targeting key individuals with preventive detention, Delhi Police seeks to disrupt supply chains and protect communities from the harmful effects of narcotics distribution.
