Dhemaji District Enforces Strict Helmet Rule for Two-Wheeler Riders

Dhemaji district magistrate Rahul Suresh Javir issued a crucial order on Friday. This directive makes helmet use mandatory for all two-wheeler riders entering government and private offices, schools, colleges, and educational institutions across the district. The measure aims to curb road accidents and enforce traffic safety norms effectively.

Immediate Implementation Under BNSS 2023

The order comes into force with immediate effect. It uses Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. The rule prohibits employees, students, and staff members from entering institutional premises without wearing protective helmets while riding two-wheelers.

District magistrate Rahul Suresh Javir explained the reasoning behind this decision. He stated that non-use of protective helmets by two-wheeler riders continues to be a major cause of serious injuries and fatalities in road accidents within Dhemaji district.

Strict Compliance and Entry Denial

All heads of departments, heads of offices, principals, headmasters, and institutional heads must ensure strict compliance with this order. Any employee, student, or staff member arriving on a two-wheeler without a helmet will face immediate consequences.

They will be denied entry to the premises. Furthermore, they will not be permitted to mark attendance for that day. The order clearly states that such attendance shall be treated as absent. This applies under applicable service rules, academic regulations, and institutional norms.

Alignment with Motor Vehicles Act

The directive emphasizes that this measure is necessary in the interest of public safety and discipline. It aligns perfectly with Section 129 of the Motor Vehicles Act, 1988. This existing law already mandates wearing of protective headgear by both riders and pillion riders of two-wheelers.

Display and Enforcement Responsibilities

All institutional heads have received specific instructions. They must prominently display the order in English and Assamese at conspicuous locations within their premises. They must also ensure that no two-wheeler rider or pillion rider without a helmet gains entry or parking within office premises under their administrative control.

The order places clear responsibility on institutional leaders. It states that the responsibility for strict enforcement and compliance of this order shall rest with the respective Heads of Offices and Heads of Institutions. This makes institutional heads directly accountable for proper implementation.

Legal Consequences for Violations

The order includes a strong warning about violations. Those who break this rule will invite action under Section 195 of the Bharatiya Nyaya Sanhita (BNS), 2023. Other relevant legal provisions may also apply. This underscores the seriousness with which authorities view helmet compliance.

This comprehensive approach aims to create a safer environment for all two-wheeler users in Dhemaji district. By targeting educational and workplace settings, the district administration hopes to instill better safety habits among riders.
