Family Alleges Delay in 'Little Nirbhaya' SC Review Petition

The family of a seven-year-old girl, known as 'Little Nirbhaya', has publicly accused the Uttarakhand government of not showing serious intent in pursuing a review petition in the Supreme Court concerning her 2014 rape and murder case. This comes despite the state's assurance of a robust legal fight following the apex court's acquittal of the accused in September 2025.

Background of the Tragic Case and Legal Journey

The horrific incident dates back to November 2014 when the minor victim had travelled to Haldwani to attend a wedding. The crime triggered massive public outrage and widespread protests across the Kumaon region, especially in Pithoragarh, leading to the arrest of the accused.

Both a trial court and the Uttarakhand High Court had convicted the accused and awarded him the death penalty. However, in a significant turn of events, the Supreme Court acquitted him in September 2025. The top court pointed to "serious loopholes in the investigation" and ruled that the prosecution, which relied solely on circumstantial evidence, failed to prove the charges beyond reasonable doubt.

Government's Stance and Family's Discontent

Following the acquittal, Chief Minister Pushkar Singh Dhami directed officials to file a review petition in the Supreme Court and engage a powerful legal team. The CM had asserted the government's commitment to justice, stating, "The govt is committed to ensuring punishment for those guilty of atrocities against the state's daughters. Such heinous acts in the land of the gods will not be spared."

However, the victim's family now expresses deep frustration over what they perceive as a lack of urgency. Tara Chand, the girl's uncle, stated on Thursday that despite government assurances three months ago, there has been "no seriousness" in following up. The family warns of launching a fresh agitation if the government fails to act promptly.

Official Response and Next Steps

When contacted, Home Secretary Shailesh Bagauli countered the allegations, clarifying that the review petition has indeed been filed. He informed that the state government has engaged Solicitor General of India Tushar Mehta to pursue the case, denying any slackness in the process.

Despite this official stance, the aggrieved family remains unconvinced. They have issued a clear warning, stating, "If the govt does not take proper action, we will start a new agitation for justice." This sets the stage for potential renewed public protests in Uttarakhand as the legal battle for 'Little Nirbhaya' continues in the nation's highest court.
