Goa Government to Introduce Landmark Advocate Protection Legislation

The Goa government has announced a significant legislative initiative to protect legal professionals in the state. In response to escalating incidents of violence, intimidation, harassment, and false implication of advocates in criminal proceedings, the government will introduce the Goa Advocate Protection Bill 2026 in the Assembly.

Comprehensive Protection Framework with Stringent Penalties

The proposed legislation establishes a robust statutory mechanism designed to safeguard advocates while preventing potential abuse through appropriate checks and balances. The bill contains substantial penalties for those who target legal professionals, including imprisonment of up to seven years and fines reaching Rs 1 lakh for the most severe offenses.

According to the cabinet statement, "The bill aims to create a balanced statutory mechanism that safeguards advocates from targeted violence and harassment, while simultaneously preventing abuse of such protection through appropriate checks and penalties."

Specific Penal Provisions for Different Offenses

The legislation outlines graduated penalties based on the severity of offenses against advocates:

  • Assault or use of criminal force against an advocate: Up to two years imprisonment and fines up to Rs 55,000
  • Causing grievous hurt to an advocate: Maximum seven years imprisonment and fines up to Rs 1 lakh
  • Intimidation or harassment of an advocate: Up to two years imprisonment and fines up to Rs 25,000
  • Threats involving death, grievous hurt, or property destruction: Imprisonment may extend to seven years

Constitutional Imperative and Judicial Independence

The cabinet emphasized that the Constitution of India envisions a justice delivery system founded on the rule of law, access to justice, and the independence of institutions essential to the administration of justice. Advocates, as officers of the court and integral participants in the judicial process, play a crucial role in securing constitutional rights and ensuring effective enforcement of legal remedies.

"Interference with advocates in the lawful discharge of their duties impairs the fundamental right of litigants to legal representation and access to justice," the cabinet statement declared.

Rising Threats to Legal Profession

In recent years, Goa has witnessed increasing incidents of violence, intimidation, harassment, false implication, and property damage against advocates while they discharge their professional duties. These acts not only endanger individual legal professionals but also threaten the independence of the legal profession and the proper administration of justice throughout the state.

The proposed legislation represents a proactive response to these concerning trends, aiming to create a safer environment for legal practitioners to perform their essential functions without fear of retaliation or obstruction.
