North Goa Court Clears Man in 2018 Fatal Scooter Accident Case

A North Goa court has acquitted Mohammad Riyaz Shaikh of charges related to causing death by negligence in an alleged case of rash riding from 2018, which resulted in the death of a senior citizen. The court's decision came after it found that the prosecution failed to provide sufficient evidence to prove that Shaikh's actions directly led to the fatal incident.

Details of the 2018 Accident

The incident occurred on August 6, 2018, at approximately 8 PM near Pernem in North Goa. According to the case details, Shaikh was allegedly riding a scooter without valid insurance and was carrying excess pillion riders at the time. His vehicle collided with 62-year-old Krishna Jagannath Polji, who was walking from Pernem towards Parsem.

Polji was declared dead at the Pernem community health centre following the accident. The pillion riders on Shaikh's scooter also sustained injuries in the collision. It was further alleged that Shaikh fled the scene without providing medical assistance to the victim or informing the police about the incident.

Court's Observations and Reasoning for Acquittal

In its ruling, the court highlighted several critical shortcomings in the prosecution's case. The investigating officer (IO) admitted to not examining the three sole eyewitnesses to the accident, stating that their whereabouts were unknown and no other witnesses could be found.

While the prosecution successfully established that an accident did occur at the specified location and time, involving Shaikh's scooter and resulting in Polji's death, it failed to prove that the accident was caused by rash and negligent riding on Shaikh's part.

The court explicitly noted in its observation: "I am of the opinion that the prosecution failed to prove that the accused rode his vehicle in such a way that it showed disregard for life and safety of others." This lack of conclusive evidence regarding Shaikh's riding behavior formed the cornerstone of the acquittal decision.

Legal Implications and Case Outcome

The acquittal underscores the importance of thorough investigation and evidence collection in legal proceedings involving traffic accidents. Despite the tragic outcome of the 2018 incident, the court maintained that without proof of rash or negligent behavior, the charges of causing death by negligence could not be sustained.

The case serves as a reminder of the legal standards required for conviction in such matters, where establishing intent or recklessness is crucial beyond merely proving that an accident occurred.
