Ahmedabad: The Gujarat High Court has granted regular bail to a woman who was behind bars with her young child after being arrested for allegedly peddling 72 grams of mephedrone, a commercial quantity.
Case Background
The accused, Parvinbanu Kureshi, was arrested in connection with an FIR registered with Karanj police in 2024, and contraband was recovered from her. She has three children, and she went to jail with her youngest child.
Arguments for Bail
Kureshi demanded bail, stating that she acted only as a carrier for Rs 50,000 and the sender was her uncle and the receiver was her aunt. She also argued that both the accused, her uncle and aunt, were granted regular bail by the court and sought the benefit of parity. She further submitted that the chargesheet against her had been filed.
Opposition by State
The state government opposed the plea, stressing the seriousness of the offence and her role as the person from whom the contraband was recovered.
Court's Decision
Granting conditional bail to Kureshi on her furnishing a Rs 25,000 bond, the High Court noted: "This court has considered the fact that present applicant is a lady accused, having three minor children and whereas it also appears that one child of the present applicant is with the present applicant in judicial custody."
